Bizdeals365 is a website for advertising businesses for sale and business asset liquidation. It also provides a business broker directory and a franchise directory. Buyers and sellers can connect through our platform to buy or sell businesses or business assets. Users may also use broker directory services to find relevant brokers or franchise directory services to buy and sell franchises.

The services provided are merely in the form of online advertising. Bizdeals365 has no involvement in any transaction as a broker, direct seller or buyer and we do not act in the capacity of a business broker, loan broker, money transmitter, payment manager, debt collector or credit reporting agency. You are supposed to directly contact the buyer, seller, broker or franchise operator and independently verify the information provided by the advertiser. All the listing information is uploaded by the advertisers themselves and they are solely responsibile for the contents including without limitation, text, audio, video, images and links to other websites. We assume no liability or responsibility for the contents or the linked websites. Moreover, advertising and purchasing services on our website is not a guarantee of success. We do not guarantee and are not responsible for any outcome of using the services provided.

Bizdeals365 has the rights to operate the website at its sole discretion and would have the control over the structure, appearance, functionality, content, user interface and the content that will be placed on the website. In case of any technical problems associated with the website, the User should first try to make reasonable effort to investigate and look for possible solutions to the problem. Failing which, they can contact Bizdeals365 for a resolution of the issue. We do not guarantee any immediate resolution of the issue after the User contacts us.

Obligations of Users

Users must be at least 18 (eighteen) years old to use the website or its services. Users may be required to choose a username and password and register an account. • Conduct themselves in harassing, vulgar, offensive or objectionable manner.

License Grant and Other Rights

When the User submits content and relevant information to BizDeals365, the User gives BizDeals365 and its affiliates a royalty-free, perpetual and irrevocable license and fully sublicensable rights to reproduce, use, publish, display, modify, prepare derivative works, sell, distribute and take any other action with respect to the content submitted. User Privileges

Privileges to use the account services are granted exclusively to the individual registered User only. Each User must maintain a valid email address that would also be their username. They must safeguard their password and notify BizDeals365 in case of any security breach. It is forbidden to share, re-assign, sublicense, or transfer your account to someone else without securing a written permission from BizDeals365. We may cease or refuse service to any User for the violation of any terms and conditions.

Listing Submission and Administration

Any advertisement listed on the website, shall remain listed until taken down by the User who has posted it or the period for which the listing was created has expired or in case it is taken down or modified by Bizdeals365 due to the breach of any terms of this Agreement. Users agree that they will not submit or display any content that is in violation of copyright act or any other laws. They also agree not to use the our website for displaying the content that misrepresent, cause controversy or against public interest in anyway. In such cases, it will be treated as violation of this agreement and we reserves the right to remove such listings. Moreover, any losses or liability incurred due to fraudulant or false representation will be the responsibility of the User and he/she will be liable to pay any attorney’s fees, legal costs or other cost which may be incurred by bizdeals365. All the submitted images are for the promotion of business opportunities only. Multiple business advertisements under a single listing or multiple listings for the same opportunity is prohibited. After listing a business opportunity, the same listing cannot be edited or modified to sell or promote a different business opportunity or entity. We have the authority to have the listing or any part of it, investigated, displayed, accessed, modified, downloaded, copied, linked and otherwise referred to by any means we deem useful or necessary. The User will ensure (or require their representatives, if applicable) to respond to all the inquiries related to thier listings within seventy two hours in a professional and respectful manner and provide all the information to the prospective buyers as per their enquires at free of cost so that they can take an informed decision. Listing on our site does not guarantee lead generation. We do not verify the content of any listing. It’s the responsibility of the user to independently verify the nformation posted by the advertiser. We do not give any assurance that the listing would result in any lead generation. We take all the reasonable measures to maintain data backup and resume website operation in case of system or network interruption but we do not gaurantee continuous uptime. User agrees that there are no refunds for such downtimes that may occur from time to time.The User also agrees to preserve the backup copies of all the information, photographs and other material uploaded on our sites. Under no circumstances BizDeals365 will be held accountable for any loss of data, downtimes and any losses that may result from it.

Moreover, you warrant and represent that:

• You are entitled to post the Information on our website and have all the necessary licenses and consents to do so.

Bizdeals365 provides a Franchise Directory service to prospective clients. Franchisors or their authorized representatives can list their business in order to get prospective investors interested in investing in their Franchise. Any person listing on behalf of a Franchise must have necessary permission and authorization from the Franchisor in order to create the listing. Bizdeals365 does not provide any assurance that any leads will be generated as a result of posting on our site. The User acknoweledges that lead generation depends on the quality and potential of the Franchise in addition to various other factors. Any agency or third party which intends to post a listing on behalf of a franchise, must provide a written authorization from the Franchisor, which states that the agent or marketing representative is duly authorized by the Franchisor to create such listing.

Broker Directory

BizDeals365 provides broker directory services that helps User find qualified business brokers. Bizdeals365 does not give any assurance regarding lead generation for the Brokers who list their services on the website. Certain states and territories require a business broker license to operate in those states. Brokers listing their services on our site must hold a valid broker license in those states and make true representation of their qualifications. In case of a broker making false representation of their skills, qualifications, experience or expertise, we reserve the rights to ban such broker from using the services of the website and take down any listing by the broker without any refund or listing fee paid by the broker. Bizdeals365 does not verify the skills, experience, or expertise of the brokers listed on the website, neither does it suggest that their services shall be useful or suitable for a particular purpose. Users interested in hiring any broker listed on the website, must independently verify broker’s qualification, expertise, license, experience and claims made by the advertiser.

Buying and Selling Business Assets

Bizdeal365 also provides a platform for buying, selling or liquidating the assets of a company. Liquidators and business owners interested in selling assets of their businesses may list them on our website. Any person listing on behalf of the asset owner, must have the necessary permission and authorization from the business owner who owns the assets in order to create the listing. We do not provide any guarantee that such listing will result in an actual sale. This is not a liquidation auction marketplace. We merely provide a listing platform where you can advertise assets for sale.

Use of information and Copyrights

All the content of our website, is the property of BisDeals365. Such content is protected by copyrights and various international intellectual property rights, laws and treaties. User is prohibited from copying, reproducing, or storing the content and from using it for further distribution, publication, or for any derivative work. Charges, Payments and Suspension

BizDeals365 charges a listing fee which is determined solely by BizDelas365 and can be changed anytime. We can impose other additional charges for any services. All the charges must be paid in advance. Listings will remain visible on our site as long as the payments are processed successfully. We reserve the right to suspend a user account or restrict access to the site without prior notice. Cause of suspension or restriction includes but not limited to violations of the terms of this Website, illegal activity, fraudulent usage, inappropriate messaging, nonpayment, technical issues, security issues or account inactivity. Upon suspension of account or restriction of usage, bizdeals365 has no obligation to maintain any data or content, associated with any user account within its servers. User agrees and acknowledges that we do not offer any refunds under any circumstances. In case of subscription, it’s the responsibility of the User to cancel the subscription before they want to take down their listing. We do not offer neither full nor prorated refunds in any case including but not limited to - sale of a business or asset, cancellation or suspension of account, or deletion of a profile. If you wish to close an account that has unused credits or cancel a subscription in the middle of a subscription period, no pro-rated refunds will be allowed. It is your responsibility to cancel the subscription that you had created. Our website may be down from time to time for the maintenance purposes, system crashes or other reasons. You agree that no refund will be given to you for such downtime. All credits are non-transferable.

Premium ads get prominent placement in the search results. This process is solely determined by our algorithms and is non-debatable

In case of disputes or discrepancies associated with the charges or payments, the User must notify BizDeals365 about such discrepancy within 15 days after the incidents has happened. If a User fails to report the discrepancy within 15 days, the user agrees to waive any claim associated with such discrepancy.
